State Regulations update
The Education and Early Childhood Services (Registration and Standards) Regulations 2025 (State Regulations) and the Education and Early Childhood Services (Registration and Standards) (Amendment of Schedule 2 of Act) Regulations 2025 (Regulations to amend Schedule 2 of the Act) commenced on 1 December 2025.
The State Regulations repealed and replaced the Education and Early Childhood Services (Registration and Standards) Regulations 2011. The State Regulations include:
- Administrative elements for the ESB such as the prescription of designated entities, peak bodies and the delegations of the Board.
- Regulation of residual early childhood services including modifications of the National Law.
- Regulations relating to schools including exclusions, requirements for registration and reviews of registration and records.
The regulations to amend Schedule 2 of the Act contain the changes that vary the modifications to the National Law for residual services under Schedule 2 of the Education and Early Childhood Services (Registration and Standards) Act 2011 (State Act).
Community Child Care Fund Restricted (CCCFR) early childhood education and care services are funded by the Australian Government to deliver education and care. This funding supports services to address barriers in childcare participation, particularly targeting disadvantaged and vulnerable families and communities.
The recent regulatory amendments introduce minor technical updates and formally incorporate the nine CCCFR services under state-based regulation as residual services under a modified National Law. These changes strengthen consistency and quality across early childhood education and care services in South Australia.
