Enforceable Undertakings
An Enforceable Undertaking is a written agreement between an Approved Provider or an individual that outlines actions they will take to reduce non-compliance with the National Law and Regulations.
This type of action is used when there is evidence of a breach, or potential breach of the National Law and Regulations which may justify enforcement action, but voluntary action by the Approved Provider or individual is most likely to encourage ongoing compliance.
Enforceable Undertakings are designed to address non-compliance through prevention and remediation. Their purpose is to reduce risk through voluntary modification of practices, behaviours or skills.
The ESB publishes Approved Provider Enforceable Undertakings on its website here.
The Guide to the NQF has detailed information about Enforceable Undertakings in Chapter 5, Regulatory Authority Powers.
