Issue of Emergency Action Notice (Section 179 of the National Law) on 23 February 2026, requiring the following by a specified time: 

  1. Remove the log and relocate the picnic table away from the perimeter fence. 
  2. Ensure the entrance gate remains closed and secured at all times. 
  3. Ensure all external doors remain locked during operating hours unless directly supervised. 
  4. Secure access to the garden storage shed.

Action Taken: 
Amendment of service approval by the regulatory authority on 9 February 2026. The following conditions are imposed. 

  1. This approval is granted subject to the conditions as set out in Section 51 of Schedule 1 of the Education and Early Childhood Services (Registration and Standards) Act 2011 and any conditions prescribed in the Education and Care Services National Regulations and Education and Early Childhood Services (Registration and Standards) Regulations 2011. 
  2. From 6:30AM on Monday 9 February 2026 until a date determined by the Regulatory Authority, the service must not provide education and care to more than 80 children at a time. 
  3. From 6:30AM on Monday 9 February 2026 until a date determined by the Regulatory Authority, the service must operate with one (1) additional educator above minimum requirements in rooms with children aged 24 months and older, at all times. 
  4. From 6:30AM on Monday 9 February 2026 until a date determined by the Regulatory Authority, the service must conduct and record headcounts every 30 minutes in all rooms at the service. 
  5. From 6:30AM on Monday 9 February 2026 until a date determined by the Regulatory Authority, the service’s Nominated Supervisor and Assistant Director are excluded from ratio calculations and must operate in a non-contact capacity. 

Tea Tree Gully Childcare Centre (SE-00011024)

Issue of Emergency Action Notice (Section 179 of the National Law) on 18 Feb 2026, requiring the following by a specified time: 

  1. From 6:30AM ACDT Thursday 19 February 2026 until 6:30PM ACDT Wednesday 4 March 2026, the service is not to provide education and care until the following directions have been actioned:
    a. Undertake a full deep clean of all indoor and outdoor areas of the service.
    b. Remove all clutter, excess stored items and unused materials from all rooms and areas accessible to children, including the toddler room, over two rooms, baby rooms and the unused approved space.
    c. Ensure the baby sleep room is used solely for sleep and rest and is free from storage and climbing hazards.
    d. Replace all cots that do not meet current Australian Standards.
    e. Remove all highchairs, emergency cots and equipment stored in a manner that presents climbing or injury risk.
    f. Remove all tyres, debris and unsafe materials from the outdoor environment.
    g. Remove the unstable blue structure located in the outdoor environment.
    h. Repair the leaking tap, remove and correctly store all hoses.
    i. Trim all grass, weeds and fence lines and remove overgrown vegetation.
    j. Trim all rose bushes and vegetation obstructing emergency exits and ensure emergency egress pathways are clear at all times.
    k. Secure or permanently restrict access to the unused outdoor area and remove all debris from that space.
    l. Repair structural defects, including cracked internal walls and the damaged veranda/awning near the emergency exit.
    m. Provide evidence from a qualified building professional confirming that the premises are structurally sound and safe for use as an education and care service.
    n. Provide photographic and documentary evidence to the Regulatory Authority demonstrating that all required actions have been completed prior to any application to resume operation.

Camp Australia – Calvary Lutheran Primary School OSHC (SE-00010212)

Issue of Emergency Action Notice (Section 179 of the National Law) on 13 February 2026, requiring the following by a specified time: 

  1. Any child who presents for care with incorrect, incomplete or outdated medical documentation, or without required current medication, must not attend the service until all identified issues have been corrected. Checks must be conducted and recorded by the service to confirm compliance before the child is accepted into care.
  2. Immediately cease using the internal door that leads to the hallway where children’s bags are kept and provide evidence that it is locked and not in use during service operating hours.
  3. The Service Director must operate in a non-contact role and may not be included in child to  educator ratios in order to support, guide and mentor service staff.
  4. Undertake an audit of all medication and medical documentation of children enrolled at the service.  
  5. Notify families of the children whose documentation or medication is non compliant, outlining the specific issues identified, and advise that those children must not attend the service until the issues are rectified. Ensure that each family is provided with a clear list of actions required to ensure their child’s medical documentation and medication is compliant.
  6. Notify the families of all children enrolled at the service of the issuance of this notice and the required actions. 
  7. Provide evidence that the children’s bag area has been repositioned and is no longer in the school corridor. 
  8. Provide evidence that all service staff have completed updated training in supervision, child safe environments, and behaviour support practices.

Hampstead Preschool (SE-00010461)

Actions required by specified times: 

  1. The Nominated Supervisor or a Responsible Person must operate in a non-contact capacity and may not be included in child to educator ratios between 8:20–9:20AM and 2:00–3:00PM and must observe and record child delivery and collection during these times. 
  2. Ensure the front entry door closed and secured during operating hours and display signage instructing that the door must remain closed.
  3. Provide evidence of communication to the families of all children enrolled at the service outlining the incident that occurred on 10 February 2026 and the actions listed in this notice.
  4. Install a child‑proof gate outside the front entrance of the service.
  5. Undertake a review of the service’s supervision and delivery/collection policies, ensuring it includes handover protocols for children with additional support needs.
  6. Provide copies of the revised supervision and delivery/collection policies to the ESB and evidence that staff have reviewed and acknowledged the changes.

  2. The service must operate with two (2) educators above the minimum ratio requirements between 7:00am–9:00am and 3:00pm–6:00pm daily. These additional educators must be deployed in a contact, in-room role and are not to be allocated to programming or administrative duties.

Action Taken: 
Issue of Compliance Notice (Section 177 of the National Law) on 28 November 2025 requiring the following a specified time: 

  1. Provide independent expert advice that includes a comprehensive assessment of the deteriorating retaining walls, considering their impact on safety, stability, and functionality of the remaining yard areas, and outlining any recommendations for remedial action or risk mitigation.
  2. Provide confirmation that a notification has been made to the ESB regarding a change to the physical premises. 
  3. Provide evidence that the premises and equipment are safe, clean and in good repair, with hazards identified in the notice rectified.
  4. Provide rectification plans and an implementation timeline demonstrating how and when the issues identified in the notice will be fully addressed.

Edge Early Learning Virginia (SE-40011894)

Approved Provider: Edge Early Learning South Australia Pty Ltd (PR-40027595)

Details: 
A Delegate of the Education Standards Board (ESB) is satisfied that the Approved Provider has contravened:

  • Section 169 – Offence relating to staffing arrangements
  • Section 174(2) – Offence to fail to notify certain information to the Regulatory Authority
  • Regulation 92 – Medication Record
  • Regulation 155 – Interactions with children 
  • Regulation 170 – Policies and procedures to be followed 

Action Taken: 
The Service Approval has been amended (Section 55(1) of the National Law) on 29 October 2025 to include the following conditions:
Effective from 30 October 2025 until 1 May 2026, the following conditions are imposed on Edge Early Learning Virginia Service Approval:

  1. The Service's Area Manager must conduct daily check-ins with the Nominated Supervisor and document all incidents, near misses, enrolment enquiries, parent complaints, and feedback received from the previous operating day.
  2. The Area Manager must be physically present at the Service for at least one full day per week in a non-contact capacity.
  3. The roles of Service Director and Assistant Director must be classified as non-contact and must not participate in the provision of education and care to children.
  4. The Service must not accept student placements. 

Happy Haven OSHC 

Compliance Type: Enforceable Undertaking         

Approved Provider: Happy Haven OSHC Pty Ltd (PR-40001361)

Approved Provider Address: 434 Montague Road, Modbury North, SA 5092

Reason for Enforceable Undertaking: 
The Regulatory Authority alleges that Happy Haven OSHC Pty Ltd has failed to comply with section 19(2) of the National Law, which makes it a condition of a provider approval that the approved provider must comply with the law.

Date of agreed Undertaking:
From 7 November 2025 until 30 November 2026, Happy Haven OSHC undertakes to address the following key areas:

  • Organisational Strategy 
  • Administration Support and Oversight 
  • Workforce and Performance 
  • Governance and Reporting 

Happy Haven offer these undertakings as a proactive demonstration of their commitment to continuous improvement and voluntary compliance. 
Further to that, Happy Haven undertakes to provide the Regulatory Authority with evidence of the following undertakings:

  1. Establish and maintain a structured plan that embeds consistent engagement of Educational Leaders across all services, including service visit requirements, while implementing strategies that support career progression and strengthen pathways into educational leadership roles.
  2. Complete a review of Serious Incident reporting.
  3. Develop and implement a risk-informed allocation plan for Relationship Managers and Professional Development Advisors to ensure robust, ongoing oversight across services that includes monthly service visits, where the following key activities are undertaken and recorded:
    - Medication audits
    - Behavioural plan reviews
    - Service Leader professional development sessions
    - Site specific training on supervision practices
  4. Review and update all position descriptions across all roles, providing clarity on key duties as they relate to child safety.
  5. Undertake a review of services operating with a sole educator and with low utilisation, provide a report with recommendations on service viability and how to manage the risks posed by these services to the ESB.
  6. Ensure information required under Regulation 168 is published online and publicly accessible.  
  7. Conduct a staff survey and a parent engagement survey, provide results to the ESB. 
  8. Conduct a review of waiver usage across all services and develop site-specific waiver exit plans, outlining clear timelines and strategies for reducing reliance on waivers.
  9. Develop and introduce a monthly case study process that reviews incident reports, examines actions taken by Happy Haven, the ESB, and explores underlying causes to enhance transparency, build understanding among onsite teams, and demystify decision-making and outcomes. 
  10. Agree not to apply for service approval, or transfer of service approval for new services in South Australia.
  11. Happy Haven OSHC is to provide the ESB with a detailed register of all educators employed by Happy Haven OSHC. 
  12. Meet with the ESB monthly, to discuss performance against the undertaking. 
  13. Notify the ESB in writing, within 48 hours, if it becomes aware of any matter which will have the effect that Happy Haven is not able to comply with any condition of the undertaking. 
  14. Understand that the ESB reserves the right to conduct inspections at any Happy Haven service during the Term of the undertaking in accordance with the National Law and National Regulations and take action proportionate to the risk presented. 


Steps taken: 
To support Happy Haven OSHC ongoing compliance with the National Law and Regulations, the ESB has accepted a written undertaking voluntarily provided by Happy Haven OSHC in line with the terms above and will monitor compliance with this undertaking over the duration. 
Failure to comply with the undertaking may result in the ESB pursuing further enforcement action, including prosecution.

Edge Early Learning South Australia

Approved Provider: Edge Early Learning South Australia Pty Ltd

Reason for Enforceable Undertaking: 
The Regulatory Authority alleges that Edge Early Learning has failed to comply with section 19(2) of the National Law, which makes it a condition of a provider approval that the approved provider must comply with the law.

Date of agreed Undertaking: 
28 August 2025 

Details of Enforceable Undertaking: 
For a period of 12 months, through to 28 August 2026, Edge Early Learning undertakes to address the following key areas:

  • Approved Provider Leadership and Oversight
  • Staff Recruitment, Induction and Ongoing Professional Development
  • Educator Conduct and Children’s Safety
  • Edge Early Learning Service and Undertaking Governance

Edge Early Learning undertakes to: 

  1. Implement an organisational structure to have one (1) Area Manager to five (5) services.
  2. Require Area Managers to undertake a visit to each service they are responsible for at least once per fortnight. 
  3. Hold quarterly all-staff meetings, either in person or virtually, to provide a comprehensive overview of operational compliance. These sessions are to be led by the Chief Executive Officer or Head of Quality, Safety and Wellbeing, who outline key themes of non-compliance and present actions for improvement across South Australian services. 
  4. Within six weeks of the undertaking commencing, Edge is to engage an external organisational psychologist to undertake a staff engagement survey, focusing what staff believe they need in order to deliver quality and safe education and care. 
  5. Within twelve weeks of the undertaking commencing, Edge is to provide the ESB with a copy of the organisational psychologist’s report and staff engagement survey results, as well as an action plan to deliver against. 
  6. Within four weeks of the undertaking commencing, Edge is to engage an external consultant to review and within twelve weeks of the undertaking commencing, provide updated policies and procedures on recruitment, induction and ongoing professional development. 
  7. Edge is to provide the ESB with a monthly register of all staff employed by Edge at services in South Australia. 
  8. Commencing four weeks after the Undertaking commencing, on a quarterly basis Edge is to provide evidence to the ESB of induction and ongoing professional development training provided to staff.
  9. Implement a reduced ratio of 1:9 children for children aged 36-months up to and including preschool age. 
  10. Within two weeks of the undertaking commencing, the Head of Quality, Safety and Wellbeing will complete a review and update of the policy and procedure on supervision and head counts. This will be implemented within six weeks of the policy and procedure being finalised. 
  11. Within four weeks of the undertaking commencing, Edge is to ensure induction of new staff includes food safety training as well as a bi-annual refresher. Evidence of implementation is to be provided to the ESB.
  12. Ensure that where a child has a known allergen, the Nominated Supervisor or Responsible Person observes and signs off on the child being provided with the correct food, with monthly reporting provided to the ESB. 
  13. Not apply to open or transfer services in South Australia for the duration of the undertaking (Twelve Months). 
  14. Meet with the ESB monthly, to discuss performance against the undertaking. 
  15. Notify the ESB in writing, within 48 hours, if it becomes aware of any matter which will have the effect that Edge is not able to comply with any condition of the undertaking. 
  16. Understand that the ESB reserves the right to conduct inspections at any Edge service during the Term of the undertaking in accordance with the National Law and National Regulations and take action proportionate to the risk presented.


Steps taken:
