You may not need a waiver for Early Childhood Teacher (ECT) requirements

ECTs or suitably qualified persons can be absent from a long day care service for a maximum of 60 days in any 12 month period if replaced by a person who holds an approved diploma or primary teaching qualification under Education and Care Services National Regulations, Regulation 135.

As part of amendments to the National Regulations in 2021, ‘resignation’ has been included as a reason for ECT absence, National Regulation 333A. This provision ceases to have effect on 31 December 2023.

Reasons for ECT absence can now be:

  • Short-term illness
  • Leave
  • Resignation

In the case of resignation, this provision may provide time for a service to recruit another ECT without needing a waiver. You should document your ECTs absence for evidence purposes.
