Freedom of Information (FOI)

Under the Freedom of Information Act 1991 , members of the public are legally entitled to access information (with certain restrictions) held by the Education and Early Childhood Registration and Standards Board of SA.

Some of the information held by the Board is already available to the public via this website. Certain information is proactively disclosed and updated regularly, and other information is available through a Freedom of Information (FOI) request. How to make an FOI request

All requests for access to documents under the FOI Act must be made in writing to:

An FOI request form is included in our Information Statement. Request forms should be accompanied by the prescribed application fee – please see the Freedom of Information (Fees and Charges) Regulations 2003.

Payment may be made by cheque or money order, made payable to the ESB, or through an electronic funds transfer.

How to make an FOI request about an early childhood services matter
All early childhood services are subject to the FOI requirements of the Education and Care Services National Law. This applies to the Commonwealth Freedom of Information Act 1982 modified by the Education and Care Services National Regulations to services regulated under the National Law: preschools; long day care; outside school hours care; and family day care services. The EECSRS Act applies parts of the National Law to residual early childhood services, including the FOI provisions without modifications made by the National Regulations.

An FOI request must:

  • be in writing (email is sufficient)
  • state that the request is an application for the purposes of the Commonwealth FOI Act
  • describe the documents you seek in enough detail to allow the decision-maker to identify and find them
  • provide an address for reply.
